Creative ideas and expression of the human mind that have commercial value and are entitled to the legal protection of a property right. The major legal mechanisms for protecting Intellectual Property (IP) are copyrights, patents, and trademarks. IP rights enable owners to selectively give access to their intellectual property and to protect it from unauthorized use. The TRIPS Agreement establishes minimum levels of protection that each government has to provide to the IP of fellow WTO members. The government of India implemented a series of policy initiatives that have energized and focused R&D on generating new knowledge that could lead to viable technologies and processes of agricultural importance. Horticulture is an important sector which link Indian agriculture and farming community to global trading opportunities. Horticulture is also unique in that it directly addresses food and nutritional security issues in both urban and rural areas of the developing world. A strengthened horticulture sector can have a positive impact on global development. The present book addresses the potential role and importance of an appropriate system of intellectual property right in sustaining innovation and technological change in important areas of horticulture. Management of IP in horticulture sector is an important step for making available technologies to all stake holders. Hence the book on "Intellectual Property Rights in Horticulture" is timely and covers all aspects of IPR. The general topics include biodiversity and IPR issues, patenting microorganisms and IPR issues in biotechnological interventions. Brief account of plant variety protection, DUS testing and geographical indication are given. The chapter on procedures in patent application writing will be useful. Approaches and different forms of IPR in fruits, vegetables, ornamental crops, spices, medicinal, aromatic and plantation crops are enumerated. ABOUT THE AUTHOR S Kannaiyan
Professor Dr. S. Kannaiyan is the former vice-Chancellor of Tamil Nadu Agricultural University, Coimbatore. He is a renowned world famous scientist in Agricultural Microbiology and Biotechnology. Prof. Kannaiyan did his B.Sc. (Agriculture) with first class and distinctions in Planat Pathology and Agronomy and M.Sc. (Agriculture) in Agricultural Microbilogy with first class and first rank from Annamalai University by securing Dr. M.P. Damodaran's and Dean's Awards. He also obtained his Ph.D. in 1976 in Agricultural Microbiology and his Ph.D. thesis was rated as the best and outstanding one for the year 1978. He was a FAO/UNDP Fellow and worked in Charles Kettering Research Laboratory, Yellow Spring, Ohio, USA. He was working as visiting scientist at University of California, Davis, USA in USDA Senior Scientific Panel Programme. He was a British Council Visiting Fellow in the University of Nottingham, UK and Visiting Scientist to the King's College, University of London, UK. Prof. Kannaiyan started his career in the Department of Agricultrue, Government of Tamil Nadu s a Research Assistant. Prof. Kannaiyan later joined as Associate Professor in the Department of Agricultural Microbiology at Tamil Nadu Agricultural University, Coimbatore in 1980. Prof. Kannaiyan is the recipient of more than 20 awards. He is a Fellow of National Academy of Agricultural Sciences (NAAS), New Delhi and the Indian Society of Biochemists and Biotechnologists. His field of specialization are Biotechnology, Alagal and Azolla Biotechnology, Biofertilizers, Nodulation in Cereals, Agricultural Education etc. He has organized many National and International Conferences. Prof. Kannaiyan has developed a strong research group and recently has got a NATP 'Team of excellence project on Biofertilizers for rice based cropping system was sanctioned in recognition of his outstanding contribution to rice Microbiology. He has published more than 400 research papers in reputed National and International Journals in the areas of Cyanobacteria, Azolla Biofertilizer, stem nodulating Sesbania rostrata and Rice Pathology. He has published 38 scientific books pertaining to Biofertilizers and Agriculture and written 14 books in Tamil on technology transfer.

Dr. V.A. Parthasarathy, Ph.D. a renowned and well-known horticulturalist cum biotechnologist of repute is the Director of Indian institute of Spices research (ICAR), calicut from 2002. He is a recipient of ICAR Team Award in Horticulture (as leader) during 2002 and is widely traveled. He has more than 30 years of research experience in Horticulture / plantation crops like citrus, vegetables, gerbera, gladiolus, coconut and spices. An expert in bio-technology and breeding of horticulture crops, he has published over 170 research articles in refereed journals, edited 15 books and contributed about 40 chapters and invited reviews. He also guided many Ph.D. students. He is member of many committees.
