"This book attempts to elucidate how gender discrimination and violence, impact our lives. The elimination of gender based discriminations is one of the fundamentals of the constitutional edifice of India. But violence against women is an obstacle to the achievement of the objective of equality, and violates and impairs the enjoyment by women of their fundamental rights. Violence against women is not always easily assessed, because perpetrators attempt to justify some practices based on religious or cultural customs.
This book serves to raise awareness and provoke action in addressing the causes of gender-based violence. Not only has the legislature played a proactive role in enacting beneficial legislation but the courts have also taken an uncompromising view in several areas — domestic violence, prenatal and pre-conception sex selection, sexual crimes etc. Cases selected are those that promote opinion-change and positive collective action. The aim of this book is empowerment by spreading knowledge and increasing awareness on violence against women, backed but authoritative case law.
The book has been formulated like a dictionary, wherein catch words have been identified under each of the listed sub-heads and catalogued in alphabetical order, that should facilitate easy access to relevant case precedents."
ABOUT THE AUTHOR Charu Walikhanna
Mrs. Charu Walikhanna is an advocate, practicing in the Supreme Court of India. Enrolled at the bar in 1998 with the aim of using law as a tool for development, she have continued to maintain a keen academic interest in legal issues. M. A. in Sociology, holder of post graduate diplomas in Intellectual Property Rights and Human Rights, International Humanitarian and Refugee Laws from Indian Law Institute and Indian Society of International Law, New Delhi respectively, she has attended the session on Public International Law at the Hague Academy of International Law, Netherlands, and is currently a doctoral scholar. Charu Walikhanna started her career in the world of advertising with a diploma from the Sir J.J. School of Art, Mumbai. Having achieved commendable success at an early age, considerably disturbed by the anomalies existing in society and by gender discrimination being faced by women, she decided to devote her time, attention, and professional interest to try and make her contribution to society. She is a member of an Inter-Ministerial Committee set up by the Ministry of Human Resource Development, Government of India and Founder and President of India and Founder and President of Social Action Forum for Manav Adhikar, an NGO working in the field of promotion of human rights and protection of the rights of vulnerable and marginalized sections of society.
