The international community does not know as yet any supreme law making body and law enforcement agency comparable to that of modern state, the treaties remain the principle method by which states maintain relations among themselves. The necessity for treaty interpretation has arisen because the words used in an instrument rarely have exact and single meanings because all possible situations which may arise under it cannot be or at least are not foreseen and expressly provided for by the parties at the time of its drafting. Thus, interpretation involves giving a meaning to a text, not just any meaning which appeals to the interpreter. This book includes the evolution of interpretation and the approaches of treaties interpretation. The book also covers a study of the provisions relating to rules of interpretation including the interpretation of treaties authenticated in two or more languages. Finally it tries to provide a clear picture of treaty interpretation with the development of the approaches taken by the International Court of justice. This book would prove a useful material to those who are interested in this subject as well as to the general readers/scholars.
ABOUT THE AUTHOR Ravi Sharma Aryal
Dr. Ravi Sharma Aryal is a CITES Law Expert and doing research related to wildlife trade and enforcement of law. Dr. Aryal is currently working as an Under Secretary in the Ministry of Law, Justice and Parliamentary Affairs, Nepal. He is contributing as a member of Wildlife Watch Group and facilitating advocacy for the people in conservatioin related wildlife law and policies. He had practiced as a private Advocate in Sypreme Court but later joined the judicial service from the last 21 years. He is an active member of Nepal Forum for Environment Journalist. Nepal Law Society Centre for Environmental Law (Nepal Law Campus) and a member of CEL (ICUN, Bonn). He has served as an expert member in different level treaty negotiations, drafting and processing of different types of Agareements on behalf of Nepalese Government. He had served as a Legal Advisor to the Ministryof Forests and Soil Conservation and had also served in different capacity as a member in Nepal. He has extensive experience indrafting Forests and Wildlife laws in Nepal. He had also worked as a Special Wildlife Court Judge for Annapurna Conservation Area / King Mahendra Trust for Nature Conservatioin for more than five years. He has also worked extensively for the implementatioin of CITES in Nepal and India. Dr. Ravi Sharma Aryal has a number of publications in both Nepali and English. He has contrtibuted “Nepal Chapter†on Environmental Law and Enforcement in the Asia-Pacific Rim Rim published by Sweet and Maxwell Asia and recently a book on “Interpretation of Treaties†was also published from Delhi, India. He is an eminent nature writer of National English Paper and has published several articles/commentaries on different journals on issues relating to Wildlife Trade, Law and CITES implementation. He holds a Bachelor ofLaws from Tribhuvan University.
