Founding fathers of the Indian constitution enshrined certain privileges to its legislators and the legislatures (the former in their individual capacity and the latter as collective bodies) under the articles 105 and 194 of the constitution. This enables them to fulfill their constitutional obligations without any fear or favour, hindrance or obstruction from any quarter but our constitution’s founders would not have even in their wildest imagination ever thought about their misuse or abuse by unscrupulous members.
Privileges are abused because of legislators arrogance and ignorance. Therefore, they should be educated properly. The present work spreads over nine chapters deal with origin and growth of privileges and also discusses the privileges of the house and its members respectively. An attempt has been made to highlight the freedom of press and the privilege motions passed against it along with an extensive coverage of reactions of the press against the motions.
The press is victimised by the authorities when it fails to dance to their tunes and this has been elaborately discussed and we believe that the privileges needed to be codified to avoid any conflict or confrontation between the legislature and judiciary.
